GEN 1.4  Entry, Transit and Departure of Cargo

1.4.1  ENTRY AND DEPARTURE OF CARGO AND OTHER ARTICLES

1.4.1.1 Aircraft operators must present one copy of a Cargo Manifest for clearance of their aircraft on entry in the territory of the Czech Republic. One more copy of the Cargo Manifest must be presented by the aircraft operator if he requires the entry customs office to certify the entry of cargo for the purpose of clearance at the exit customs office. On this copy the acceptance of cargo under customs control will be recorded. The submitted documents must follow the ICAO standard format as set forth in Annex 9 to the Convention on International Civil Aviation or any other format accepted by the Czech Republic.
1.4.1.2 Customs Administration of the Czech Republic draws the attention to the obligation to comply with another legal duties, which apply to cargo entering customs territory of the EU. These duties arise from the article 127 and following of Regulation (EU) No 952/ 2013 of the European Parliament and the Council laying down the Union Customs Code. In accordance with these provisions aircraft operators or accredited representative must present the customs office at the initial place of entry of cargo the “Entry of summary declaration” containing data necessary for risk analysis for safety and security purposes.

1.4.1.3  Regulations Concerning the Transit of Cargo
1.4.1.3.1 No special documents are usually required for cargo remaining aboard the aircraft and for trans-shipped cargo. If, however, such cargo contains drugs or poisons, a certificate issued by the competent health authority of the state of origin must be provided. If the cargo contains arms or ammunition, there must be a covering document issued by the respective Consulate of the Czech Republic. Provided that trans-shipped cargo contains veterinary goods it is necessary to report it to the veterinary border office Prague-Ruzyne:

1.4.1.3.2 Transport of cargo which could endanger the safety of flight, namely arms, explosives, ammunition, corrosives, radioactive materials and easy inflammable articles, is permitted only under the conditions specified by the air carrier and with his advance agreement.
1.4.1.4  Transport of Dangerous Goods or Weapons
1.4.1.4.1 The transport of weapons shall be conducted in accordance with valid Regulation (EC) of the European Parliament and of the Council and valid Commission Regulation (EU).
1.4.1.4.2 The transport of dangerous goods shall be conducted in accordance with Annex 18 to the Convention on International Civil Aviation as last amended and in accordance with the Technical Instructions for the Safe Transport of Dangerous goods by Air (ICAO Doc 9284), including its supplements and any other addenda or corrigenda.
1.4.1.4.3  In instances:

  1. of extreme urgency; or

  2. when other forms of transport are inappropriate; or

  3. when full compliance with the prescribed requirements is contrary to the public interest,

the Ministry of Transport, Civil Aviation Department may grant an exemption from the provisions of the Technical Instructions provided that in such instances every effort shall be made to achieve an overall level of safety in transport which is equivalent to the level of safety provided for in the Technical Instructions.

Request for an exemption shall be submitted in writing at least 30 days before the date of the intended flight at one of the following contacts:

Request for an exemption in addition to the applicable information according to GEN 1.2 para 2.2.2.2 includes at least the following:

  1. the reason why it is essential the article or substance must be carried by air;

  2. a statement why the applicant believes the proposal (including any safety control measures specified by the applicant) will achieve a level of safety equivalent to that provided for in the Technical Instructions;

  3. proper shipping name, classification and UN number with full supporting Technical data;

  4. the proposed packaging;

  5. quantity to be carried;

  6. any special handling required and any special emergency response information;

  7. name and address of shipper and consignee;

  8. the airports of departure, transit and destination including the dates and estimated times.

The Civil Aviation Department of the Ministry of Transport shall request to submit appropriate documents and to provide additional information necessary for a consideration of a request and for potential granting of an exemption.

1.4.2  IMPORT OF LIVE ANIMALS AND PLANTS

1.4.2.1 Imported live animals shall be attended by relevant veterinary certificate and submitted for entrance control at the veterinary border office Prague-Ruzyne.

In case of breed animals (dogs, cats, etc.) this control is provided by custom offices within the custom control of passengers and their personal baggages at following airports: PRAHA/Ruzyne, BRNO/Turany, OSTRAVA/Mosnov, Karlovy Vary and Pardubice.

A quarantine on imported animals can be ordered as one of the proceeding in case that import conditions are not accomplished.

1.4.2.2 For imported plants or parts of plants (with the exception of 5 kg of vegetables and 5 kg fruit) a phytopathological certificate issued by the respective authority of the state of origin shall be provided. Such plants and parts of plants are moreover subject to phytopathological inspection.
