ENR 1  GENERAL RULES AND PROCEDURES

ENR 1.1  General rules

The air traffic rules and procedures applicable to the provision of air traffic services in the Czech Republic conform to Commission Implementing Regulation (EU) No 923/2012 of 26 September, as amended, Annexes 2 and 11 to the Convention on International Civil Aviation and to the relevant portions of the Doc 4444 (Procedures for Air Navigation Services − Air Traffic Management) and Doc 7030 (Regional Supplementary Procedures).

1.1.1  CONDUCTING OF FLIGHTS

1.1.1.1 Unless otherwise decided by bilateral or multilateral agreement between the Czech Republic and the respective states international flights may be only operated to/from the international aerodromes. This regulation is not applied for aircraft arriving/departing from/to the territory of the Schengen area states.
1.1.1.2  IFR flights up to FL 95 incl. except flights in CTA 1 PRAHA and TMA PRAHA may be planned only along the designated ATS routes or DCT segments defined in RAD. The DCT segments published in RAD (see AIP ENR 1.10 para 2.5) are applied for planning of IFR flights within CTA 1 PRAHA and TMA PRAHA. All flights above FL 95 except flights in TMA PRAHA (FRA) may be planned only in compliance with Free Route Flight Planning published in RAD (see AIP ENR 1.3 para 4).

 

1.1.1.3 Combined IFR/VFR flights to/from aerodromes not approved for IFR operations (further “flights to/from uncontrolled aerodromes” only).
1.1.1.3.1 On pilot request and on the base of a real activation of segregated reserved and restricted areas and when necessary upon coordination with military ATC units concerned, an ATC unit can clear aircraft executing combined IFR/VFR flight to continue under IFR as far as the uncontrolled aerodrome of destination or after departure from such an aerodrome to change VFR to IFR rules before the change of rules point designated in the flight plan, provided the following specific conditions are fulfilled:
  1. Change of IFR to VFR flight rules and vice versa shall be executed at the latest or earliest over the aerodrome of destination or departure.

  2. The aircraft under IFR proceeding to an uncontrolled aerodrome may be cleared to descend by an appropriate ATC unit to a designated Minimum Flight Altitude or Minimum Radar Vectoring Altitude only.

  3. Pilots intending to depart from uncontrolled airfields within SECTOR CECHY WEST, SECTOR CECHY EAST and SECTOR MORAVA, shall contact PRAHA FIC before departure on telephone number

    and coordinate the way of changing the flight rules to IFR. After departure from the uncontrolled airfield the pilot shall, as soon as possible, establish radio communication with an appropriate civil ATC unit in accordance with previous coordination and request clearance for IFR flight.

  4. The change of VFR to IFR rules of aircraft departing from an uncontrolled aerodrome may be executed after the aircraft has reached the designated Minimum Flight Altitude or a ATC Surveillance Minimum Altitude.

  5. The aircraft operating according to the above−mentioned rules must be capable of RNAV−5 navigation.

  6. At least one alternate controlled aerodrome with IFR operation has to be inserted in the flight plan submitted by an operator for such a flight.

  7.  

1.1.1.4 Engine start−ups shall be in accordance with the local procedures. If the local procedures permit, pilot−in−command or a responsible representative of the aircraft operator who intends to start−up engines at a controlled aerodrome without approval from ATC, is obliged to check with the aerodrome operator whether prohibition of engines start−ups is not or will not be declared.
1.1.1.5 Minimum levels of flights

Minimum levels of flights are determined by ICAO Annex 2. Additional restrictions for flights over Praha are in detail given in LKPR AD 2.23.

1.1.1.6 The route of flight will not be indicated in the enroute air traffic control clearance when it is identical with the route inserted in filed flight plan.

Note: The route of flight will be indicated in ATC clearance in case of difference from submitted flight plan.

1.1.1.7 If the pilot−in−command does not receive taxi instructions from TWR before landing, he/she shall leave the RWY after landing run out using any nearest suitable TWY unless otherwise specified by local procedures published in AIP AD. After leaving the RWY the pilot−in− command shall not continue further taxiing until obtaining taxi clearance. When leaving the RWY the pilot−in−command shall not backtrack on RWY or taxi via other RWY without obtaining taxi clearance from TWR.

1.1.2  PROVISION OF FLIGHT INFORMATION SERVICE AND ALERTING SERVICE

Flight information service and alerting service are provided to the following extent:

1.1.2.1  Flight Information Service

Flight information service is provided by all ATS units within their area of responsibility. Flight information service encompasses:

  1. Information concerning known air traffic and a risk of collision. Pilots of VFR flights operating in class G or E airspace requiring traffic information shall, after establishing radio contact, pass information in following order:

    1. identification of aircraft;

    2. type of aircraft;

    3. position;

    4. flight level;

    5. track;

    6.  

  2. Information about the condition of airports and services in FIR PRAHA is provided for all flights on request only.

  3. Information about reported meteorological conditions en−route and at airports, including airport forecasts, is provided for all flights within the area of FIR PRAHA on request only. Information concerning meteorological conditions along the track, which could make VFR flights impossible, is provided on initiative of ATS units on the basis of flight plan to pilots having radio contact.

  4. Information about the use of segregated, reserved and restricted areas within the area of FIR PRAHA is provided on request only. The validity of received information about current use of TSA or TRA is 15 minutes. As soon as this time limit is up the pilot must either ask for updated information or consider the area as activated.

1.1.2.1.1  Aerodrome Flight Information Service (AFIS)
1.1.2.1.1.1 Aerodrome Flight Information Service (AFIS) is provided on an uncontrolled aerodromes published in manual of the Czech Republic and in Aerodrome Traffic Zone (ATZ) of these aerodromes within aerodrome operational hours and encompasses the following information:
  1. runway in use and circuit direction;

  2. surface wind direction and speed;

  3. aerodrome QNH;

  4. significant weather on the aerodrome;

  5. current runway surface conditions and essential aerodrome information, as appropriate;

  6. general information about the aerodrome, on request;

  7. relevant information reported by pilots of other aircraft (wind shear, turbulence, etc.);

  8. information concerning air traffic and risk of collision. This information includes only known traffic in the area of the AFIS unit responsibility which could constitute a risk of collision.

1.1.2.1.1.2 Establishing of the radio contact with unit or Providing information to known traffic unit is compulsory for an aircraft equipped with radio set, operating on an uncontrolled aerodrome and/or within an ATZ, when commencing taxiing and/or prior entering an ATZ. Pilots shall transmit their reports whether or not an AFIS or Providing information to known traffic is provided.
1.1.2.2  Alerting Service
1.1.2.2.1 Alerting service is provided to all flights for which a FPL was submitted, to all flights where air traffic control service is provided and to all flights known or believed to be in need of such a service.
1.1.2.2.2 Provision of alerting service to VFR flights for which was submitted is determined by transmitting DEP message or by transmitting report of departure according to ENR 1.2 para 2.2 or by handing over other message to relevant ATS unit from which it is evident that a flight is operated according to the FPL and contains the estimated time of arrival.
1.1.2.2.3 The Air Navigation Services of the Czech Republic shall provide alerting service to VFR flights in class E and G airspace in case the pilot declares state of emergency or reports a problem to unit that may affect the safe completion of the flight. If a pilot flying without a FPL declares on frequency state of emergency or reports a problem related to the safe operation of the flight, he/she shall, as soon as circumstances allow, report to the ATS unit the departure aerodrome, flight route, destination aerodrome, estimated time of arrival, number of persons on board and fuel endurance. If the pilot does not report state of emergency termination or problem termination or in case of communication failure he/she shall immediately after landing transmit the report of arrival to the last contacted ATS unit. As appropriate, unit declares uncertainty phase, alert phase or distress phase in accordance with ICAO Annex 11.

1.1.3  AIR − GROUND RADIO COMMUNICATION FAILURE PROCEDURES

1.1.3.1  Radio communication Failure − general
1.1.3.1.1 If radiocommunication failure prevents an aircraft operated as a controlled flight from maintaining continuous listening watch on the appropriate radio frequency, and two−way communication as necessary with the appropriate air traffic control unit, the aircraft shall follow radiocommunication failure procedures listed in ICAO Annex 10, Volume II and further adhere to procedures specified in ICAO Doc 4444.
1.1.3.1.2 The following radionavigation aids are designated at aerodromes in case the aircraft operates in accordance with provisions of ICAO Doc 4444, para 15.3.3 b) 4):

1.1.4  FUEL DUMPING PROCEDURES

1.1.4.1 Fuel dumping shall not be carried out within the FIR PRAHA unless an ATC clearance has been issued by the relevant ATC unit. The minimum flight level for fuel dumping is FL 60 with the exception as stated in the provision ENR 1.1 para 4.3 below.
1.1.4.2 Other known traffic will be separated from the aircraft dumping fuel by:
  1. at least 10 NM horizontally, but not behind the aircraft dumping fuel;

  2. vertical separation if behind the aircraft dumping fuel within 15 minutes flying time or at a distance of 50 NM by:

    1. at least 1000 ft if above the aircraft dumping fuel; and

    2. at least 3000 ft below the aircraft dumping fuel.

1.1.4.3 In case the fuel dumping after take−off is urgent, only minimum sector altitude shall be respected.
1.1.4.4 Whenever a fuel dumping is performed its beginning, completion and the reason for fuel dumping shall be reported to the relevant ATC unit.

1.1.5  AIR REFUELLING OF AIRCRAft IN CTA PRAHA

1.1.5.1 The air refuelling is provided under VMC and is carried out without assistance of air traffic control service. On request of the pilot−in−command of the tanker aircraft ATC service will provide a navigation assistance and possibly radar information for the creation of air refuelling formation.
1.1.5.2 Radio communication between a formation carrying out the air refuelling and ATC service is ensured by the pilot−in− command of the tanker aircraft who shall report starting and terminating of air refuelling to the appropriate unit.
1.1.5.3 The pilots−in−command when manoeuvring associated with air refuelling shall follow the Czech aeronautical regulations and they are fully responsible for prevention of collision among aircraft participating in air refuelling.
1.1.5.4 During air refuelling ATC units provide standard ICAO vertical separation from the highest and the lowest flight levels in the assigned block of levels for air refuelling. A horizontal separation minimum between the formation of aircraft participating in air refuelling and other traffic is provided by maintaining minimum 6 NM between the non standard formation envelope occupied by aircraft participating in air refuelling or aircraft flying on the edges of the formation and other traffic.
1.1.5.5 Phraseology used for air refuelling:
  1. Report starting refuelling;

  2. Report terminating refuelling;

  3. Join formation maintaining own separation.

1.1.6  FORMATION FLIGHTS

1.1.6.1  Standard formation flights

Formation flights can be carried out in accordance with the following conditions and principles:

1.1.6.1.1 Aircraft flying in formation shall be considered as a flight of one aircraft when ATS is provided (emergency service is provided to all aircraft in formation).
1.1.6.1.2 When submitting a flight plan (FPL), registration marks of other aircraft in the formation shall be inserted in field 18 after the abbreviation REG.
1.1.6.1.3 The leader of a formation operating without a FPL shall announce registration marks of aircraft in formation when first radio contact is established with the air traffic control unit.
1.1.6.1.4 Separation between aircraft in the flight shall be the responsibility of the flight leader and the pilots-in-command of the other aircraft in the flight. Each aircraft shall maintain a distance not exceeding 1 km (0,5 nm) laterally and longitudinally and 30 m (100 ft) vertically from the flight leader.
1.1.6.1.5 In case of break up the formation, the leader of formation shall report this fact to ATS. unit than ensures separations among the aircraft. Radio contact with each aircraft is maintained according to its registration mark.
1.1.6.1.6 Assigned SSR code shall be switched on by the formation leader only. Other aircraft of the formation will have their transponders on "STANDBY" code as the formation leader, unless they receive other instructions from ATC unit.
1.1.6.1.7 Minimum radar separation from formation flight is increased by 2 km (1 NM) and minimum radar separation 5,6 km (3 NM), as per ICAO DOC 4444 Chapter 6 para 6.7.3.2.4, is not applied. For ensuring lateral separations to facility, angle separation is increased adequately at the air traffic controller discretion.
1.1.6.1.8 Orders or instructions to the formation leader shall be given in sufficient time to enable him/her to give orders to be executed by other pilots of his/her formation.
1.1.6.1.9 Take−offs and landings are carried out in a formation unless the formation leader requests to provide air traffic service separately for each aircraft in the formation when a formation flight is carried out within aerodrome traffic.
1.1.6.1.10  Maximum number of aircraft in formation
1.1.6.1.10.1  VFR flight
  1. Maximum number of aircraft in the formation is not limited if all aircraft are equipped with a radio.

  2. If the lead aircraft are not equipped with a radio, maximum number of aircraft in the formation is four.

1.1.6.1.10.2  IFR flight
  1. For IFR flights all aircraft in the formation have to be equipped for IFR flights and crew shall have an IFR qualification.

  2.  

  3. The leader of the formation is responsible for pre−flight briefing of each member of the formation flight and for execution of the flight. He/she shall state procedures to each member of formation for take−off, for flight through clouds during climb and descend, cruise and landing including emergency procedures, or when for any reason the formation flight will be discontinued.

  4. The responsibility for decision and performance of formation VFR or IFR flight with respect to meteorological conditions rests with the formation leader.

1.1.6.2  Non−standard formation flights
1.1.6.2.1 Only military aircraft obtain clearance to operate in non− standard formations along ATS routes within the airspace of the Czech Republic. The following procedures shall be applied only when civilian ATS units provide ATS services to these aircraft.
1.1.6.2.2 When aircraft operate in a non−standard formation, a number and type of aircraft shall be inserted in a flight plan. Information given under Item 18 of the flight plan shall be: "RMK/FORMATION WITH (call signs) IN THE BLOCK FLxxx TO FLxxx".
1.1.6.2.3 A non−standard formation leader shall report, at the latest 5 minutes prior entering FIR PRAHA, on the appropriate ATC unit operational frequency the following:
  1. Type of the formation (e.g. "IN TRAIL");

  2. Distance between the formation leader and the last aircraft in the formation (the overall formation length) and the width of the formation, if exceeding 1 NM;

  3. Number of aircraft;

  4. Number of required levels;

  5. Location and time of expected break−up of the formation.

1.1.6.2.4 Unless otherwise instructed by ATC, only the formation leader (tanker aircraft) shall switch on assigned SSR code and communicate with ATC.
1.1.6.2.5 Flights in non−standard formations can be conducted only on the basis of ATC clearance. The formation leader is responsible for maintaining separation between aircraft in the formation.
1.1.6.2.6 Planned/required split of the formation can be conducted only upon an ATC clearance. In case the split of the formation has been approved by ATC, responsibility for separations among the formation aircraft rests with the formation leader until the conditions given by ATC clearance have been fulfilled. The ATC will use the phrase: "DESCEND/CLIMB TO FL XXX MAINTAINING OWN SEPARATION UNTIL REACHING/CROSSING FL XXX".
1.1.6.2.7 In case of the formation break up (non−planned/non− required), this fact must be reported to the ATC. The formation leader remains responsible for separations among the formation aircraft until the conditions given by ATC clearance have been fulfilled. ATC provides available information about other traffic until the ATC is able to provide standard ICAO separations.

1.1.7  RULES FOR CONDUCTING OF AEROBATIC FLIGHTS

1.1.7.1 The Civil Aviation Authority of the Czech Republic (CAA CZ) has specified the following rules on the basis of ICAO Annex 2 − Rules of the Air para 3.1.7:
  1. The airworthiness of aircraft performing an aerobatic flight shall be approved by competent authority.

  2. Pilot−in−command of the aircraft performing an aerobatic flight shall be the pilot with the appropriate qualification for aerobatics or the pilot in training of aerobatics (ACR) according to training scheme approved by CAA CZ. Requirements for aerobatic flights qualification does not apply to the training and test of particular manoeuvres included in the training scheme of the basic training.

  3. Pilot may carry out solo aerobatic flight pursuant to decision of the approved instructor and it shall be recorded in the pilot’s logbook.

  4. During aerobatic flights the crew and any other person on board shall be equipped with emergency parachutes.

  5. Aerobatic flights shall not be performed over over densely built-up areas, an open−air assembly of persons, above a part of the airport open to public, or in case of a public performance above the area for spectators up to the defined boundary of flying displays. The place for aerobatic flights should be chosen with regards to noise and other restrictions published in the AIP of the Czech Republic, VFR manual of the Czech Republic, set by the airport regulations of the airport or reported by the AFIS operator, Providing information to known traffic or by the ATS unit. An area suitable for possible emergency landing during aerobatics shall be available.

  6. The aerobatic flight shall not be performed without approval of the aerodrome operator regarding to density and type of other operations at the aerodrome, in or ATZ. The aerodrome operator may issue to the pilot time or airspace restriction to perform aerobatic flight.

  7. Unless otherwise approved by the CAA CZ, the aerobatic flight shall not be performed:

    1. at a height less than 600 m AGL for airplanes and helicopters;

    2. at a height less than 400 m AGL for gliders.

    The Civil Aviation Authority can approve aerobatics in lower heights for individual pilots − see “Conditions for the organization of flying displays” published on the CAA CZ website in Czech language, http://www.caa.cz/.

  8. Flight visibility during an aerobatic flight within class G airspace shall be at least 3 km; this does not apply to an open−air performance or competition, where relevant airspace has been declared a restricted area.

1.1.8  RULES FOR THE DROPPING OF OBJECTS, SPRAYING WITH LOOSE MATERIAL AND LIQUIDS FROM CIVIL AIRCRAft

The Civil Aviation Authority of the C.R. has specified the following rules on the basis of ICAO Annex 2 − Rules of the Air, para 3.1.4:

1.1.8.1 By adhering to the specified conditions the following activities may be carried out without special permission:
  1. Parachute descents and dropping of flares under conditions specified in "The Instruction For Carrying Out Sports Parachute Jumping" issued by the Civil Aviation Authority indicated as CAA− LP−001−0/96.

  2. Dropping of advertising leaflets of max. size A 5 performed by operators authorized for conducting of aerial works, who have this activity specified in The Operational Specification and in The Operational Instruction.

  3. Dropping of ballast from untethered balloons but only in form of fine sand, or jettisoning of water ballast from gliders.

  4. Aerial spraying in agriculture, forestry and environmental works by operators authorized for these activities with certified application equipment; the activity has to be listed in The Operational Specification and in The Operational Instruction of the operator, and has to be performed by pilots, who are fully trained and licensed for this special activity. Only substances authorized by the Ministry of Agriculture can be applied by air and responsibility for their correct use rests with the person who commissioned these works.

  5. Extinguishing of forest fires performed by operators authorized for this activity with certified aircraft having certified application equipment; the activity has to be listed in The Operational Specification and in The Operational Instruction of the operator; and has to be performed by pilots who are fully trained and licensed for this special activity.

1.1.8.2 If the activities from paragraph a) to paragraph e) are carried out within airspace classes C or D the pilot−in−command has to obtain ATC clearance from an appropriated ATC unit.
1.1.8.3 Any other dropping from civil aircraft than listed above may be approved by the Civil Aviation Authority based on a request submitted by operator no less than 30 days before the planned date of the requested activity.

The request must include above all:

  1. the name of the aircraft operator

  2. the reason for the requested activity and information about the customer of dropping

  3. the definition of a dropping area and its contingent closing, a restriction of entry and designation

  4. the designation, quantity, eventually a sample of dropped subjects and their detailed specification (weight, dimension, shape, material) and a conclusion of skilled authority if it is necessary

  5. type of aircraft specified for dropping

  6. the location of departure and arrival of aircraft, the days of carrying out

  7. the signature of statutory representative

In case of a dropping approved based on a request the civil aircraft operator shall adhere to the conditions specified in the approval for dropping and also shall:

  1. ensure that only approved objects are dropped and in the authorised quantity (batches)

  2. instruct the persons carrying out the dropping of objects about their behaviour during flight

1.1.8.4 The pilot−in−command shall carry out the flight in accordance with specified conditions and Czech national aeronautical operational regulations. He shall have relevant authorisation for dropping of objects with him.
1.1.8.5 Crew members dropping the objects shall follow the pilot−in−command instructions concerning behaviour during flight and the method of dropping objects.
1.1.8.6 If it becomes impossible to adhere to the conditions for safe dropping of objects from civil aircraft, the operator or pilot−in−command shall cease the dropping.

1.1.9  USE OF AIRSPACE OF THE CZECH REPUBLIC

Use of airspace of the Czech Republic is carried out in compliance with the Commission Regulation (EC) No. 2150/2005 by which the common rules for the flexible use of airspace (FUA) are established and incompliance with Article 3 of Commission Implementing Regulation (EU) 2017/373 and is further regularized by provisions §44, 44a, 44b and 44c Act. No. 49/1997 Coll. on Civil Aviation and Decree No. 108/1997 Coll.

1.1.9.1  Airspace Management in the Czech Republic
1.1.9.1.1 Airspace Management (ASM) is treated in accordance with the legal documents referred above in ENR 1.1 para 9 and with the strategy of ECAC states and their FUA Concept.
1.1.9.1.2  ASM is realised at three levels:
  1. strategic ASM 1

  2. pre-tactical ASM 2

  3. tactical ASM 3

1.1.9.1.2.1  Strategic level - ASM 1

This level is provided by Civil Aviation Authority (thereinafter CAA) together with the Ministry of Defence and according to the Regulation (EC) No. 2150/2005, Article 4 in cooperation with ASM Commission (hereinafter KASM). “Airspace Management Policy of the Czech Republic (hereinafter The Policy) describes responsible authorities, its responsibilities and principles related to joint civil-military strategic planning of Czech airspace use. The Policy is approved by CAA after consultation with Ministry of Transport and Ministry of Defence, represented by ODVL SSŘO MO (Military Aviation Authority). The Policy is available on the CAA website, section ATM/, part ASM.

In order to consult and form ideas and suggestions within working level of airspace management, Consulting Group of ASM (KSASM) is founded by KASM.

After consultations within KSASM, KASM provides its viewpoints to responsible authorities on:

  1. Czech airspace management in order to conduct flights safely and provide aeronautical services efficiently and

  2. requests for temporary reservation of parts of airspace to an one user or category of users if the areas are not published in AIP CR, ENR 5 and time of reservation exceeds 24 hours during three consecutive days since the day of reservation.

Area planning procedures - ASM 1 level

Airspace structure modifications are carried out in compliance with Implementing Regulation (EU) 2017/373 and according to the procedure published in Article 10 of the Policy.

The applicant is obliged to consult the airspace change proposal with the affected parties known to the applicant and forward the consultation results to a designated airspace designer. The applicant is further obliged to provide the submitted request together with the airspace designer’s proposal including the results of validation proposal and results of compatibility check for a given airspace.

Since 27 JAN 2022, Air Navigation Services of the CR become the airspace designer nominated by the state. The activities of the airspace designer are free of charge for the applicants.

In accordance with Article 3 (9) of Implementing Regulation (EU) 2017/373 the airspace administrators are obliged to provide cooperation and necessary supporting documents to the airspace designer for periodic reviews and maintenance.

Airspace users are requested to submit applications to CAA in these cases:

  1. requirements for restriction or prohibition of the use of an airspace;

  2. requirements for temporary reservation of parts of airspace, where reservation period exceeds 24 hours during three consecutive days from the day of reservation and the areas are not areas published in AIP CR ENR 5 ("AMC manageable” areas).

Request for a temporary reservation of parts of airspace, subject to approval by the Authority pursuant to § 44 paragraph 2, 3, 5, 6 of Act No. 49/1997 Coll., on Civil Aviation, must be submitted to the CAAno later than 60 days before the date from which the reservation is required.

Requests for temporary airspace reservation must include all elements in accordance with § 16 of Decree No. 108/1997 Coll MD. Vertical limitation of requested airspace must be in accordance with AIP ENR 1.1 para 9.3.1.

Note: Considering the terms of regular KASM meetings (http://www.caa.cz/letiste/asm) and deadlines resulting from administrative code, it is recommended to submit requests more than the requested minimum of 60 days ahead, 85 days ideally. Further, it is necessary to consider the time required for drafting a proposal by the airspace designer.

1.1.9.1.2.2  Pre-tactical level - ASM 2

Planning procedures for airspace use - ASM 2 level

Users of temporary reserved areas, where reservation period does not exceed 24 hours during three consecutive days from the day of reservation and the areas are not published inAIP ENR 5 are requested to:

  1. submit to the AMC CR the application for reservation of airspace 7 working days before the proposed activity (D - 7 working days), not later than 1000 UTC.

Requirements for temporary reservation of part of airspace, shall include:

  1. purpose and nature of the activity for which the reservation is required;

  2. timing of the reservation, the date and time of commencement and completion of the activity for which the reservation is required, the time is reported in UTC;

  3. horizontal limits of reserved area in World Geodetic System coordinates - 1984 (WGS-84) supplemented by geographic identification of each location according to the Aeronautical Chart ICAO;

  4. vertical limits of reserved area specified in levels used in aviation: flight levels, altitudes or heights according to ENR 1.1 para 9.3.1;

  5. identification of the subject responsible for issuing permission to enter or fly through the reserved airspace, including telephone contact, call sign and frequency used.

Attachment to the application is a map plotting or an outline of the requested area in electronic form.

In the event of a conflict of a requirement with already existing Czech airspace structures, or conflict between the two requirements, AMC CR decides according to priorities in accordance with § 16 paragraph 6 of Decree No. 108/1997 Coll MD and published Policy.

Users of reserved areas published in the AIP CR ENR 5 ("AMC manageable" areas) are requested to:

  1. submit requests for airspace reservation to the AMC CR on the day before the proposed activity (D-1), not later than 1000 UTC.

Requirements for temporary reservation of part of airspace shall include:

  1. designation of required area (according to );

  2. timing of the reservation, the date and time of commencement and completion of the activity for which the reservation is required, the time is reported in UTC;

  3. vertical limits of reserved area (using levels used in aviation);

  4. additional supplementary data (when required).

1.1.9.1.2.3  Tactical level - ASM 3

This level is performed by appropriate civil and military ATS units and AMC CR in accordance with the Commission Regulation (EC) No. 2150/2005, Article 6. In real time they activate and deactivate temporary reservation of the areas (according to AUP/UUP) or they re-allocate the areas to other users to allow for their more efficient usage. Activation/ deactivation of an area (according to AUP/UUP) is based on notification by the user about real usage of the assigned airspace.

Airspace use procedures - ASM 3 level

Users of reserved areas are obligated to:

  1. use the airspace in accordance with the AMC CR allocation and according toAIP ENR 1.1 para 9.3.2;

  2. through the PRAHA FIC:

    1. activate the reserved area not later than 20 minutes before commencing the activity within the area;

    2. deactivate the reserved area immediately whenever the particular activity is suspended within the area for more than 1 H;

      Note: The interruption of the activity for 1 H and less is not reported;

    3. cancel the reserved area immediately after termination of the activity in the area or after the decision on non-use of the area.

Note: If the user does not activate the restricted area, this area will be treated as free space and other flights being allowed to enter this area without restriction.

1.1.9.2  Temporary Airspace Allocation Process
1.1.9.2.1 Airspace managed by AMC and identified as "AMC manageable” areas inAIP ENR 5 are allocated.

Activation time of areas not managed by AMC (not "AMC manageable”) is published in the AIP CR.

Planned hours of activity and conditions for the use of AMC manageable areas are published daily in the Airspace Use Plan (AUP).

1.1.9.2.2 Requirements of users for temporary reservation of parts of airspace not published in AIP, are published via NOTAM or AIP SUP and reference to appropriate publication is also listed in AUP.
1.1.9.2.3 Time parameters for activation of "AMC manageable” areas.

Activation times are defined as follows:

  1. Published hours - cover the maximum possible activation time; they are published in AIP ENR 5 in the Remarks column.

  2. Planned hours - published in the AUP; they are within the published hours.

  3. Real Activation Time - is the actual period of use of the area known from the area user who performs the activity; it is within the planned hours published in AUP.

1.1.9.2.4 Vertical limits for planning and activation of Manageable” airspaces are appointed according to ENR 1.1 para 9.3.1.
1.1.9.3  Principles of airspace vertical limits planning and use
1.1.9.3.1 Users of the airspace are required to plan vertical usage of the airspace as follows:
  1. up to 1000 ft AGL use AGL heights;

  2. above 1000 ft AGL up to 5000 ft AMSL use IFR levels according to AIP ENR 1.7 para 5;

  3. above 5000 ft AMSL up to FL 290 use VFR levels according to AIP ENR 1.7 para 5 ;

  4. from FL 290 to FL 410 use number expressing a level between two IFR flight levels ended with digit "5" (FL 295 - FL 405);

  5. above FL 410 use a number expressing a level between IFR flight levels ended with digit "0" (FL 420 - FL 660).

1.1.9.3.2 In order to assure safe separation of aeronautical activity inside the assigned airspace and air traffic performed outside such an area its users are allowed to use the assigned airspace at least 500 ft (1000 ft above FL 410) over the lower limit and at least 500 ft (1000 ft above FL 410) below the upper limit of the assigned airspace defined vertically by flight level (i.e. over 5000 ft AMSL) according to AIP ENR 1.1 para 9.3.1.

Note: If an ATS unit has to assure a greater vertical separation than specified, (e.g. for the reason of aircraft not equipped for flight in RVSM airspace or a group flight, fuel jettisoning) such a separation must be assured in the ATS unit's area of responsibility.

1.1.9.4  Conditional Routes (CDRs)

Conditional routes ATS (CDR) and areas for direct routes (DCT) are being created in addition to permanent ATS routes within the FUA concept. DCT list is published in RAD.

1.1.9.4.1 CDRs are divided into three categories according to their availability, their flight planning potential and the anticipated level of activity of associated areas.
1.1.9.4.2 Category one (CDR 1) - Permanently Plannable CDR during the times published in AIP unless otherwise specified in EAUP.
  1. CDRs 1 are routes expected to be available for most of the time during the time period published in AIP.

  2. CDRs 1 are flight planned in the same way as permanent ATS routes during the times published in AIP.

  3.  

  4. In the event of a short notice unavailability of a CDR 1, rerouting around an associated Manageable" Area will be made on ATC instructions.

1.1.9.4.3 Category Two (CDR 2) - are routes plannable during periods published in EAUP messages only.
  1. CDRs 2 are part of predefined routing scenarios which respond to specific capacity imbalances.

1.1.9.4.4 Category Three (CDR 3) are not plannable routes
  1. CDRs 3 are published in AIP as CDRs usable on ATC instruction only.

1.1.9.4.5 List of CDRs 2 in the ECAC area is published daily in the EAUP report, which is published on NM NOP Portal for flight planning purposes.
1.1.9.5  Submission of the complaints to ASM

Airspace users can submit complaints to ASM agenda in a written form to the Civil Aviation Authority.

1.1.9.6  Airspace use assessment
1.1.9.6.1 Regular assessment of airspace use in compliance with Commission Regulation (EC) No. 2150/2005 is an important means to increase the confidence among airspace users and an important tool for improvement of organization and airspace management.
1.1.9.6.2 Users of TRA and TSA record usage of these areas (number of flights, number of aircraft, time utilization of planned area, booking time, activation time, deactivation time). These data are to be sent in written form on 15th day of each month at the latest to the Authority to further processing and subsequent use. All written statistic data and electronic data related to the use of TRA and TSA are stored at least for 3 months.
1.1.9.6.3 Form and content of statistical records being sent to the Authority by users of TRA and TSA is, with regard to different character of its use, notified and continuously rectified by the Authority to individual users of these areas. The result of such statistical data processing is the assessment that is a part of ASM regulation process and is used especially to improve the organisation and airspace management.

1.1.9.6.4 CAA in cooperation with AMC uses statistical data based on AUP/UUP reports and information generated by real activation of monitored areas for assessment which is a part of ASM regulation process and is used especially to improve the organisation and airspace management.
1.1.9.7  Airspace Management Cell (AMC) - Airspace Use Plan (AUP) and Updated Airspace Use Plan (UUP)
1.1.9.7.1 The airspace allocation is published in a daily Airspace Use Plan (AUP). The AUP is published before 1400 UTC to cover the 24 hours time period between 0600 UTC the next day to 0600 UTC the day after (D 0600 - D+1 0600).
1.1.9.7.2 Airspace allocated in the current AUP that are cancelled/changed on the day of operations will be promulgated through the Updated Airspace Use Plan (UUP) effective immediately. Airspace or CDR2 allocated in the current EAUP will be cancelled/changed at the times allocated by NM/CADF. When needed, more than one UUP can be promulgated within the validity period of the current AUP.
1.1.9.7.3 The AUP/UUP will only be transmitted to designated users, including ACCs/FMPs, to the CADF, to adjacent AMCs in accordance with the Letters of Agreement. Additionally, the AUP/UUP are published on the Air Navigation Services of the Czech Republic web pages (http://aup.ans.cz). As national AUP/UUP are not sent to aircraft operators, the information provided by AMCs on CDRs 2 availability in the ECAC area will be published by the NM/CADF in a consolidated international message, the EAUP.

1.1.10  OBSERVATION FLIGHTS CONDUCTED UNDER THE TREATY ON OPEN SKIES

1.1.10.1 Under the terms of the Treaty on Open Skies, the Czech Republic is committed to accept Observation Flights of the teams from any of the signatory countries over any part of the Czech territory as well as transport and transit flights of the Observation Teams.
1.1.10.2 Observation Flights will be conducted to/from Pardubice aerodrome.
1.1.10.3 On the basis of the Treaty Observation Flights are entitled to enter any prohibited, segregated, reserved or restricted area. Users of these areas are obliged to ensure safe transit based on notification of intended Observation Flight. Users of areas involved will receive the notification in the written form from the Airspace Management Cell (AMC) or by phone from the appropriate ATC unit in case the aircraft is already in the air.

1.1.11  ARRANGEMENTS FOR PARTICULAR NON− STANDARD TYPES OF FLIGHT

1.1.11.1  Non−Standard Flights (NSFs) in Controlled Airspace
1.1.11.1.1 A NSF in Controlled Airspace is considered to be an aerial activity which does not follow published routes or notified procedures (e.g. Test or Photo Survey Flights, Air−to−air refuelling, VFR flights above FL 195, etc.).
1.1.11.1.1.1 Applications for NSFs within Controlled Airspace should be submitted to the address listed below the minimum 3 working days’ notice:

1.1.11.1.1.2 Applicants using e−mail should ensure that the file's total size does not exceed 5 MB
1.1.11.1.2 Applications should include:
  1. Purpose of flight;

  2. Requested airways and/or the area of operation and proposed tracks to be flown − 1 copy of a suitable aeronautical chart, with a list of coordinates detailing the requested area of operation in relation to Controlled Airspace;

  3. Estimated duration of aerial activity;

  4. Operating levels;

  5. Aircraft type, callsign and registration letters on any aircraft likely to be used;

  6. Aerodrome of departure and destination;

  7. Planned date of operation, EOBT and requested validity period.

1.1.11.1.2.1 Those applications which are agreed will be allocated a non−standard flight (NSF) reference number. This is only a preliminary approval and prior clearance must be obtained from the appropriate ATC unit on the day. This is normally obtained by telephone 1 hour prior the departure.
1.1.11.1.2.2 Operators are to note that in no circumstances can any discussion be entered into on any frequency in the event that permission is refused or withdrawn.
1.1.11.1.3  ATC clearance does not imply exemption from the requirements of the AIP CR or other regulations.
1.1.11.1.4 Because of the nature of ATC operations (and notwithstanding the requirements of GEN 1.5 para 1.1 concerning the carriage of SSR transponders), the approval of an application for a Non−Standard Flight (NSF) will depend on the carriage of SSR transponder equipment normally with Mode S with Elementary Surveillance.
1.1.11.1.5 Due to the inherent difficulties of handling NSF in a busy traffic situation, pilots should be aware that it may not always be possible to issue an ATC clearance at the time requested.
1.1.11.1.6 Above mentioned procedure does not affect CAA and ANS CR flights.
1.1.11.2  Test flights of civil aircraft in LKTRA37 and LKTRA62

Test flights of civil aircraft in spaces LKTRA37 and LKTRA62 can be carried out in accordance with following conditions and principles:

1.1.11.2.1 Request for test flight must be approved by LKVO (AD 2−LKVO−1), which will provide air traffic control service in LKTRA37 and LKTRA62 at least day prior to the planned test flight before 0900 (0800), if the next day is a working day. Activities planned for the weekend to Thursday 0900 (0800). The request must contain:
  1.  

  2. type of aircraft;

  3. operator;

  4. date of flight;

  5.  

  6. intended activity of test flight − further details included;

  7. estimated duration of test flight;

  8. confirmation of the ability to keep the border of area (crew's ability to fly with own navigation).

1.1.11.2.2 Confirmation of request for test flight.

LKVO will coordinate the test flight with other possible users of LKTRA37 and LKTRA62.

LKVO will either approve the test flight or offer new time or date.

1.1.11.2.3 Recommended days and times to execute flights
  1. Monday, Friday, Saturday and Sunday

  2. Tuesday, Wednesday, Thursday − from 0800 (0700) to 1500 (1400)

1.1.11.2.4 Activities before the flight

1.1.11.2.6 An exemption from compliance to rules described in the article ENR 1.1 para 11 ARRANGEMENT FOR PARTICULAR NON− STANDARD TYPES OF FLIGHT is approved for test flights.
